As seen below, the Judicial Council has revised several forms in the areas of real property, estates, trusts, and property claims.
In the area of decedent’s estates, Form DE-120, Notice of Hearing – Decedent’s Estate or Trust, has been revised which has been modified to include the legend by Prob C § 12201(b) regarding the right to petition for an account in the case of a status report under Section 12200. There is now a box to be checked in item 1 of the notice if the notice relates to such a status report. The language in item 1 has also been changed to refer to “a petition, application, report, or account,’ which is to be identified by its complete title and briefly describe[d].”
Form DE-115, Notice of Hearing on Petition to Determine Claim to Property, is new and approved for mandatory use. It includes the information required by Prob C § 851(c).
Forms DE-306, Affidavit re Real Property of Small Value, DE-310. Petition to Determine Succession to Real Property, and DE-315, Order Determining Succession to Real Property, have all been revised to reflect the new maximum value of property that can be dealt with under Division 8 (commencing with Section 13000) of the Probate Code under Ch 122, Stats 2019, which took effect on January 1, 2020.
